These Terms of Use ("Terms") constitute a legally binding agreement between you and Hot Seat ("Company," "we," "us," or "our") governing your access to and use of the Hot Seat mobile application and website at hotseatprep.com (collectively, the "Service"). By downloading, installing, or using Hot Seat, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use Hot Seat. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service. By using Hot Seat, you represent and warrant that you meet these eligibility requirements.
You must create an account to use Hot Seat. You agree to provide accurate, current, and complete registration information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your account with others, create accounts for other people without their consent, or create multiple accounts to circumvent subscription requirements or other restrictions.
Hot Seat offers Pro subscriptions on a monthly and annual basis. Subscriptions are purchased through Apple's App Store and are subject to Apple's standard purchase terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Hot Seat for personal, non-commercial preparation and educational purposes.

By uploading content, you grant us a limited, non-exclusive license to process and transmit that content to third-party AI services (OpenAI) solely for the purpose of operating the Service on your behalf.

Hot Seat is powered by large language model AI. All questions, responses, feedback, scores, and analysis generated by the AI are automated outputs produced for training and preparation purposes only.

The Hot Seat app, website, logo, design, features, and all content we create are owned by Hot Seat and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, or other proprietary branding.
AI-generated session content (questions, feedback) is generated on your behalf for your personal use. We do not claim ownership of the specific AI outputs generated during your sessions.
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Hot Seat, you consent to the data practices described in the Privacy Policy.
HOT SEAT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content. Your use of AI-generated content is entirely at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOT SEAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Hot Seat, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, and 13) will survive.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, conducted in New York, New York.
You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notification. Your continued use of Hot Seat after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
